Personal Injury Demand Drafter
The Personal Injury Demand Drafter is responsible for preparing persuasive, well-supported settlement demand packages to insurance carriers prior to litigation. This role requires strong legal writing skills, a thorough understanding of personal injury law, insurance policies and coverage, and the ability to analyze medical records and damages to present compelling case narratives that maximize settlement value.
Key Responsibilities
- Case File Review: Review, organize, and analyze client files including medical records, bills, police reports, photographs, insurance policies, and witness statements.
- Demand Letter Drafting: Draft comprehensive, detailed, and persuasive settlement demand letters clearly outlining liability, causation, injuries, treatment, damages, and applicable insurance coverage.
- Damage Calculation: Accurately calculate and summarize medical expenses, lost wages, future damages, and pain and suffering in alignment with policy limits and coverage terms.
- Medical Record Analysis: Interpret and summarize medical records and billing to establish causation and support claimed damages.
- Insurance Policy Analysis: Review and interpret auto, liability, UM/UIM, PIP, MedPay, and bodily injury policies to identify coverage, exclusions, limits, and applicable endorsements.
- Insurance Communication: Identify adjusters, submit representation and demand packages, and respond to coverage-related inquiries.
- Lien Management: Obtain, track, and assist with negotiation of medical, health insurance, and provider liens.
- Case Support: Assist attorneys and case managers with demand-related documents, track deadlines, and maintain accurate and complete case files.
Required Experience & Qualifications
- Experience: 2–5 years of experience in personal injury law with demonstrated experience drafting settlement demands and handling pre-litigation files.
- Legal Writing Skills: Exceptional written communication skills with strong grammar, organization, and persuasive legal writing ability.
- Personal Injury & Insurance Knowledge: Strong understanding of personal injury claims, medical terminology, damages, and insurance policy interpretation, including coverage analysis and policy limits.
- Detail-Oriented & Analytical: Highly organized with the ability to analyze complex medical, factual, and insurance information and synthesize it into compelling narratives.
- Communication Skills: Effective communicator with attorneys, paralegals, case managers, and insurance adjusters.
- Technical Skills: Proficiency in Microsoft Word and familiarity with legal case management systems (e.g. Litify, Needles, or similar).
